
The iPod that sparked a fight leading to an October 2010 shooting was located in an entryway closet at the home of the iPod owner, police said during a trial over the shooting.
Witnesses at the trial of Steven Voegele testified on Tuesday that Trevor Miller believed his iPod was missing during a party at his home on Oct. 2, 2010, and his roommate, Nicholas Reed, began questioning people about the music device. A fight broke out in the yard over the iPod, and two men ended up shot. Police located an iPod matching the description of the missing one in a closet at Reed’s and Miller’s home while executing a search warrant.
Xavier Thompson, 22, was killed and Voegele, 26, was injured outside the party at 200 Fifth Ave. N.E., Mandan, at 2:05 a.m. on Oct. 2. Both men had gunshot wounds, and court records indicate Thompson shot Voegele, then Voegele shot Thompson.
Voegele is standing trial on Class C felony charges of aggravated assault, reckless endangerment and terrorizing. Each of the charges includes mandatory minimum two-year prison sentences due to allegations that a firearm was used in the commission of the offenses.
Voegele’s trial began on Tuesday at the Morton County Courthouse and could wrap up on Wednesday. Prosecutors rested their case Tuesday afternoon. Defense attorney Susan Schmidt indicated she is unsure whether Voegele will testify or whether she will call other witnesses. The trial had been slated to last through Friday.
